1.4 Any abuse, fraudulent activity, or misuse of the website, services, or promotions will result in termination of access without notice.

1.6 Fraud Prevention & Account Termination: Any fraudulent, deceptive, or abusive behavior — including false refund claims, bot entries, or misrepresentation — may result in immediate termination and legal action.

2. Orders & Purchases

2.1 All orders are subject to availability. We reserve the right to discontinue or modify products at any time without prior notice.

2.2 Prices are displayed in the local currency and are subject to change without notice.

2.3 Full payment is required at the time of purchase. We accept major credit/debit cards and other methods provided at checkout.

2.4 Orders cannot be modified or cancelled once processed. Exceptions may apply at our sole discretion if the item has not yet shipped.

2.6 By purchasing, you confirm that you have read and accepted our Warranty and Returns policies and agree to the terms of sale, including warranty limitations.

3. Promotional Giveaways

3.1 Giveaways are open to eligible residents in supported regions. Entrants must be 18 years or older.

3.2 Entry is free through community subscription or by purchasing qualifying products or digital artwork.

3.3 Bonus entries may be granted for social media engagement or referrals, as specified per promotion.

3.4 Winners are selected by independent random draw and contacted via email or phone. Failure to respond within 7 days will result in a redraw.

3.5 Giveaways are not gambling events and do not require payment to enter.

3.6 Prizes are non-transferable and cannot be exchanged for cash unless required by law.

3.7 22Ultimate is not responsible for local taxes, customs duties, or other legal obligations relating to prize acceptance.

3.8 If the Promotion receives fewer entries than required to conduct the draw, the Promoter may extend the promotional period or roll existing entries into a subsequent promotional draw without further notice.

4. Safe Use & Customer Responsibility

4.1 Customers are responsible for the safe and legal operation of all products purchased. This includes:
– Wearing appropriate protective gear (helmet, pads, gloves)
– Following all local traffic and off-road laws
– Supervising underage users
– Charging products only while attended and away from flammable materials
– Regular maintenance (e.g. checking bolts, brakes, tyres, battery care)

4.2 Products are not waterproof. Water damage, stunt riding, crashes, or improper storage will void warranty rights.

4.3 22Ultimate is not liable for any injury, accident, or damage arising from misuse, neglect, or unsafe operation.

4.4 Demo, used, and clearance items are sold as-is with no warranty, unless explicitly stated otherwise in writing at the time of sale.

5. Digital Products

5.1 Digital artwork and downloadable items are non-refundable and non-exchangeable.

5.2 Customers receive non-exclusive rights to the artwork. 22Ultimate retains full ownership of all digital products.

5.3 Digital products are delivered “as-is” and may not be modified after delivery.

6. Warranty & Returns

6.1 Warranty coverage and return eligibility are governed by our Shipping & Returns Policy.

6.2 We do not offer change-of-mind refunds. Returns are only accepted for defective or incorrect items.

6.3 All in-person sales, assembled bikes, used/demo products, and final sale items are non-returnable and non-refundable.

6.4 Customers must inspect items upon receipt and report any issues within 48 hours.

7. Limitation of Liability

7.1 We are not responsible for any indirect, incidental, or consequential loss, injury, or damage resulting from product use, website use, or promotional participation.

7.2 Our liability in all circumstances is limited to the purchase price of the product.

7.3 You agree to indemnify and hold harmless 22Ultimate from any claims arising from misuse of our products or website.

8. Governing Law

8.1 These Terms & Conditions are governed by the laws of New Zealand and Australia. Any disputes must be resolved within these jurisdictions.

8.2 Any legal claim must be filed within 3 months of the issue arising.

8.3 If any provision of these terms is deemed unenforceable, the remaining terms will remain in effect.
